The NCAC has an ‘Appointment and Proceedings Committee’ whose aim is to ensure that NCAC arbitrations proceed expeditiously. Pursuant to NCAC Arbitration Rules, the Committee appoints arbitrators upon request by parties or in cases where parties have not been able to appoint any arbitrator in accordance with NCAC Rules. The Committee also decides on the jurisdiction of NCAC in case of challenges made by the parties. This normally happens before the constitution of Tribunal where the Committee is able to make a prima facie determination of the validity and applicability of the arbitration agreement, i.e. to assess whether a valid arbitration agreement exists. The Committee consists of seven experienced members with diverse backgrounds. The members are selected every three years by the Executive Board of NCAC.
